Justice Vibhu Bakhru issued notice to the income tax department and directed it to file an affidavit on Jain’s plea while listing the matter for hearing on October 11.During the hearing the I-T department said the petition should not be entertained However Jain’s counsel said the department has no jurisdiction “Proceedings are without jurisdiction I am a sitting minister and they are defaming me everywhere” he said The court then sought the I-T department’s response explaining the issue raised in the petition “File an affidavit explaining whether you have the jurisdiction or not as the same has been claimed by the petitioner” the judge said The I-T department has registered a case against Jain under the new Prohibition of Benami Property Transactions Act The department had provisionally attached the land and other assets worth over Rs 30 crore in this case The CBI too has registered a case against Jain on the I-T department’s recommendation The assets were initially provisionally attached on February 27 and the order was extended on May 24 by the IT department till the time the adjudicating authority took a final decision The court had earlier observed there was nothing wrong with the I-T department’s order under the new benami law to provisionally attach some assets allegedly linked to Jain The court had also refused to stay the proceedings before the adjudicating authority as was sought by the minister In his plea Jain had said the attachment was done as per the amended provisions of the Prohibition of Benami Property Transactions Act of 1988 and claimed that the amendment of 2016 would not be applicable in the instant case He had contended that the alleged benami transactions from the proceeds of which the attached assets were allegedly purchased took place between 2011 to March 31 2016 and therefore the amendment which came into effect in November 2016 would not apply However the court had said it was of the prima facie view that Jain would be covered by the earlier unamended provision also The court had not issued notice in the matter and had renotified it for today The income tax department had earlier said the initiating officer has only passed a provisional attachment order and forwarded it to the adjudicating authority which was yet to even issue a show cause notice It had said the adjudicating authority would give Jain an opportunity to be heard and cross-examine the witnesses before taking a final decision The counsel for Jain on the other hand had claimed that witnesses were examined by the initiating officer before passing the order but no opportunity for cross-examination was given to him The Delhi Health Minister’s lawyers had said the purchase of assets from the proceeds of benami transactions as contended by the income tax department would not be benami as per the unamended Act The tax department has alleged that Jain had funded four companies in which he used to be a director prior to his election and they in turn had bought land from the proceeds The minister had denied any involvement with the companies after his election Hundreds of bighas of land allegedly purchased in and around Delhi by the four firms have been provisionally attached by the department under the new benami law which carries a maximum punishment of up to seven years of rigorous imprisonment and a hefty penalty Updated: June 22 2016 12:09 am The selection of the governor and the role of the RBI are inextricably connected Top News The Reserve Bank of India has been singularly fortunate in being helmed by very competent governors of high integrity and stature The selection process repeatedly ensured that the appointee did the office full credit Now that the present governor has confirmed he is returning to academia when his three-year term ends in September 2016 it is perhaps apposite to reflect on the key public policy issues involved in the appointment to this office The selection of the governor and the role of the RBI are inextricably connected The central bank is the primary arm of the government to ensure good monetary and regulatory policies for the welfare of the people of the country As such the central bank cannot be fully independent of the government The governor as the head of the central bank is and has to be appointed by the executive organ of the government namely the appointments committee of the cabinet Post the north Atlantic financial crisis it is now well understood internationally that the central bank’s role in the economy goes beyond monetary policy and extends to growth and financial stability as the RBI has always practised The relationship between the executive and the central bank needs to be like a well-managed joint family — with sound though at times uncomfortable advice coming from the latter The central bank primarily responsible for maintaining internal and external values of the currency has a long-term horizon It is also well recognised that the central bank’s role is not just equal to any financial sector regulator In the public eye and in fact the governor has a unique role in the economy This is also borne out by the international experience Share This Article Related Article Watch Video: What’s making news In a developing country and indeed in any country there has to be healthy collaborative and mutually respectful relationship between the government and the central bank governor The latter has to take into account the priorities of the government and the former has to recognise the dharma of the central bank The selection of the governor has to therefore derive from the role of the office in the system The process of selection involves three questions: Who will select what kind of a person and for how long Taking the tenure first international experience generally recommends a term for the governor longer than the term of the body with the predominant influence on the appointment In the US the Banking Act of 1935 stipulates that the president appoints the seven members of the board of governors They must then be confirmed by the senate and serve for 14 years The nominees for chair and vice-chair may be chosen by the president from among the sitting governors for four-year terms these appointments are subject to senate confirmation The Bank of England governor serves for a period of eight years the deputy governors for five years and the non-executive members of the court of directors (as the board is called) for up to four years A survey of central banks the world over finds that if the term is fixed it is often around five years In India most governors have been given a tenure of five years although in many cases the initial tenure was for a shorter period Having a period shorter than five years does not allow the governor sufficient time to implement his/her agenda and it also needlessly politicises the extension of the tenure It is best to extend a five-year tenure to the governor and deputy governors What should be the qualifications for appointment The governor should have sound background of economics operational experience in public policy and a proven record of performance The person should have impeccable integrity reputation and stature befitting the position of the RBI governor He/she should not hesitate to give his/her professional unbiased advice on monetary and financial matters in the interest of the economy What should be the process There could be two situations: One where the present incumbent is eligible for reappointment and is willing to be considered for such extension The other is when a person has to be appointed afresh In the first case as the track record of the incumbent is known the only criterion should be whether the government is inclined to grant such extension based on the performance Instead of being a last minute decision this should be undertaken sufficiently in advance and announced publicly In case a five-year term is given and the incumbent is to be reappointed that too should be done in advance In a situation where the person is to be appointed afresh the Financial Sector Legislative Reforms Commission suggests an expert panel that should be the same for all regulators It should have two government representatives and three outside experts with the government representative as chair Having an expert panel of this nature where the members are at a level not commensurate with the stature and reputation of the governor is not desirable and not consistent with international practice An alternative could be a blue ribbon committee with a few former governors and finance ministers making the recommendation with the government of course taking the final call The selection of the governor has to be as sacrosanct as the function of the office itself It must add to the respect and credibility that a central bank must have for effective functioning The writer served as the foggy present” they negotiate love and loneliness hunger and health and their only comfort is also their greatest challenge — the city to which they belong “They cannot escape this place and must try anything they can to bear it” says Neel Chaudhuri director of Delhi-based theatre group Tadpole Repertory about the playThis Will Only Take Several Minutes which opens at Ranga Shankara in Bangalore today It will be staged in Mumbai’s Sitara Studio on January 25 and 26 Pune on January 29and Delhi’s Oddbird Theatre on February 1 and 2 The play is presented by Delhi-based The Japan Foundation Based in a fictional city — “not far from yours” — the play is a collaboration between Tadpole Repertory and Tokyo’s Hanchu-Yuei theatre group In the past two years the actors and directors visited malls construction sites aquariums sex shops war memorials and shrines to children lost in the womb The characters in the play emerged from observations and conversations and range from a vulnerable and damaged man played by Bikram ‘Momo’ Ghosh to Piyush Kumar’s charming rogue with his uneven English and natural Hindi diction The narrative like the urban milieu does not follow a linear structure or conventional logic The minimal set is enlivened by the use of the actor’s bodies as a performance tool as well as projected graphics animation and text Characters come together and separate and even locations and time frames are fuzzy The use of vignettes marked another city-based play by Tadpole Still and Still Moving set the forced physical intimacies in the crowded general compartments of the Delhi Metro alongside an evolving relationship between an older and a young man Hanchu-Yuei’s principal writer and director Suguru Yamamoto appears similarly motivated by realities that exist in hidden folds in plays such as I Can’t Die Without Being Born which was shortlisted for the 59th Kishida Kunio Drama Award in 2015 “There are conceptual differences in our languages and ways of seeing; something as fundamental as humour exists very differently in Japanese English and Hindi We had to work through these challenges and I think that facing them made the experience richer” says Chaudhuri That’s one of the reasons the play has two names with the Japanese title translating into ‘2amCoffee Cup Salad Bowl Utopia’ “I thought‘This will only take several minutes’ was an apt phrase and something that you hear in a hospital a government office a restaurant or even from your lover Suguru felt that while it served the play well it didn’t translate quite so effectively into Japanese So we decided that the play would have another title in Japanese” he says For all the latest Lifestyle News download Indian Express App More Top NewsBy: IANS | New York | Published: that may also cause sexually transmitted disease (STDs) researchers say Automated teller machine (ATM) keypads represent a specific and unexplored microhabitat for microbial communities “Our results suggest that ATM keypads integrate microbes from different sources including the human microbiome foods and potentially novel environmental organisms adapted to air or surfaces” said Jane Carlton Professor at New York University US “DNA obtained from ATM keypads may therefore provide a record of both human behaviour and environmental sources of microbes” Carlton added The researchers in June and July 2014 took swabs of keypads from 66 ATM machines from Manhattan Queens and Brooklyn in the US Specifically the most common identified sources of microbes on the keypads were from household surfaces such as televisions restrooms kitchens and pillows as well as from bony fish mollusks and chicken Residual DNA from a meal may remain on a person’s hands and be transferred to the ATM keypad parasite typically seen in the gut of humans and other mammals along with a species closely related to the human parasite Trichomonas vaginalis which can potentially cause STD However there was no significant difference found in the keypads from ATMs located outdoors versus indoors the researcher noted in the paper published in the journal ‘mSphere’ For all the latest Lifestyle News download
